Juror Misconduct and Jury Tampering During the Murdaugh Trial
Prominent South Carolina attorney Richard Murdaugh was convicted of murder. During the trial there were allegations of juror misconduct. In this presentation, we will examine juror tampering and juror misconduct and the proper procedure, burden of proof, and remedy when misconduct is discovered. We will review juror misconduct in this case, view film clips of the hearing to remove the juror and opine as to whether the judge’s removal of the juror was proper. Juror Misconduct and Jury Tampering: The Murdaugh Motion for New Trial
After prominent South Carolina attorney Richard Murdaugh was convicted of murder, he filed a motion for new trial alleging that the clerk of courts tampered with the jury by advising them not to believe his testimony and pressuring them to reach a quick guilty verdict. After an evidentiary hearing where a juror indicated they were influenced by the clerk to return a guilty verdict, the judge overruled the motion finding that there was insufficient evidence to overturn the jury’s verdict. In this presentation, we will examine juror tampering that was discovered after trial. We will watch film clips of the evidentiary hearing on the motion for new trial and discuss case law regarding jury tampering and the standard of proof to obtain a new trial. Whether you practice civil or criminal law, attendees will benefit from this presentation by learning about jury tampering discovered after trial and the burden of proof when filing a motion for new trial. Understanding Chronic Stress, Trauma, and Mental Illness in the Legal Profession
Lawyers face stress daily and are subject to circumstances that can lead to higher stress levels than those with other careers. There is a clearly recognized continuum where unresolved chronic stress becomes a predictor for substance use problems and mental illness, particularly depression, which are also more prevalent among lawyers.
