More Effective Writing Makes More Effective Lawyers: Focusing on the Fundamentals

  • When Lawyers Write: What Can Go Wrong?
    Take a brief tour of the various ways legal writing can come up short (or long, or confusing, or...) and the writing habits and assumptions that lead so many lawyers astray.
  • So, Here’s the Situation...” The Writing You Do Before You Start Writing
    Understand that some of your most important legal writing happens before your fingers ever hit the keyboard. And why would you think that a single approach to your writing best serves you, your clients, or your varied target audience(s)?
  • Demystifying the Process: Four Essential Questions, and Two Key Factors
    Let’s keep it simple, shall we? Learn how to streamline your writing process by focusing first on a small number of manageable elements and see how those elements will help guide you through many of your most critical writing and editing decisions.
  • “What’s In? What’s Out?” Complete v. Concise
    It may be the ultimate balancing act in legal writing: “How much is enough? How much is too much?” We’ll share strategies for fighting off the urge to include everything, and we’ll weigh the benefits – and occasional dangers – of leaving things out.
  • A Few More Words About Getting Started: Different Strokes for Different Folks
    Do you suffer from Blank Screen Panic? You’re not alone. Getting those first words onto the screen is a daunting prospect for many lawyers. Find out if your typical way of getting started is actually the best approach for the way you write, and for any particular assignment. We’ll explore some alternatives that may be a better fit.

More Effective Writing Makes More Effective Lawyers: Drilling Down on the Details

  • “Where Do I Put It?” Help Them Early – and Often
    People are busy. People don’t always know the subject matter as well as you do. Effective legal writing is more than just including all the relevant information and arguments. Organizing that information, and guiding your readers through it, can be every bit as vital. We’ll talk tips – and pitfalls.
  • “How Do I Say It?” Going for Clarity
    Most of the time, you want most of the people reading your stuff to actually understand what you’re telling them! (“Legalese” isn’t the only thing that stands in the way, although it’s certainly a factor.) How can your decisions about phrasing, punctuation, even page design, make or break your document? And can vagueness ever be a virtue? We’ll consider the possibilities.
  • “How Do I Say It?”
    Going for Brevity Page limits and word limits are just two of the reasons you’ll want to make your legal writing more concise; there are plenty of others. What are some of the best techniques for tightening, and adding power to, your writing?
  • “How Does It Come Across?”
    Your Tone, Your Voice There’s a reason people tell lawyer jokes. “You sound just like a lawyer!” is rarely a compliment. Connecting with readers on a gut level is an often overlooked – but often essential – part of effective legal writing. We’ll examine some of the factors that can help you make that connection.

Introversion Versus Extroversion in the Legal Profession: Why It Matters and How to Collaborate Better
The legal profession, and western culture, may portray extroversion as the ideal set-up for success, yet we know better – I hope. We can all think of examples of where someone being too extroverted led to a bad outcome. However, the value of introverted styles and approaches still goes unrecognized in a lot of ways – this to the detriment of teamwork, individual relationships and wellbeing, your client’s satisfaction, and the success of your team and firm. This one-hour presentation provides deeper insights into and discusses:

  • What happens when we confuse confidence and ‘easy talking’ with competence;
  • Differences in energy, thinking, responding, and style between introverts and extroverts;
  • How to understand self and others better and maximize your personal potential;
  • How introverts and extroverts can improve their relationships and collaboration.

This interactive, engaging, and practical session will strengthen collaboration on your legal teams, help build trusting relationships with clients, witnesses, and other stakeholders that are on the other side of the spectrum from you, and it will strengthen your effectiveness within the firm.

Neuroscience, Well-Being, and Ethics
The National Task Force on Lawyer Well-Being has stated that the duty of competence as articulated in Minnesota Rules of Professional Conduct Rule 1.1. “[i]ncludes lawyers’ ability to make healthy, positive work/life choices to assure not only a quality of life within their families and communities, but also to help them make responsible decisions for their clients. It includes maintaining their own long term wellbeing.” Indeed, lawyer disciplinary matters frequently involve a disability-related condition of mental health or substance abuse. This program applies the cutting-edge work in the field of neuroscience to lawyer well-being and ethical behavior.

  • Learn the latest neuroscience behind sleep and its impact on immunity, mental health, substance use, ethical behavior, and performance.
  • Learn the latest neuroscience behind trust and how to generate the moral molecule—oxytocin—to enhance ethical behavior, performance, and joy (yes, there is a biochemical basis for joy).  You cannot achieve the six pillars of well-being for yourself and your organization without trust.
  • Learn how short sleeping or inhibited rem/nrem sleep activates your lizard brain and your ability to act ethically is impaired. If you don’t generate oxytocin or know how to generate it, your behavior may be self-interested and unethical.

This program will also introduce you to a stress release protocol that is used by the U.S. military, first-responders like firefighters and law enforcement, the Red Cross, and other humanitarian organizations around the world.
