Trust is the foundation of any effective relationship. Trust plays a crucial role in creating productive collaborations, retaining clients, resolving issues, and winning cases. To be trustworthy is to act with integrity, to show yourself as dependable, to consistently do the right thing, and ultimately, demonstrate that you can be counted on to keep your commitments. However, as this last item points out, trust is also in the eye of the beholder. How do you consistently build trust and credibility? How do you regain credibility if a person feels trust is harmed? In a complex, fast-paced, and vastly changing context, subtle indiscretions like shading the truth or underdelivering on commitments can erase hard-earned credibility. The human brain is wired to recognize patterns and make generalizations, even those based on faulty or incomplete information. And it does not require that we harbor ill will or animus toward other people. In fact, most often, our biases are not even our own, but rather those that have been taught to us. The Pros and Cons of the Minnesota Non-Compete Prohibition Statute…With an Extra Helping of the Cons
Minnesota’s nearly complete ban of non-compete agreements took effect on July 1. New non-competes are out, but employers are still able to utilize nondisclosure agreements to protect their trade secrets or other confidential information, and non-solicitation agreements are available to prevent workers from soliciting clients if they move to another job. However, some folks are of the opinion that the Legislature went too far with this legislation, and the alternative routes to protecting valuable company secrets and assets are not sufficient enough to be effective. William Pentelovitch joins us to outline the reasons why he believes that this new statutory framework creates a dangerous environment for innovation in Minnesota, as well as clues us in on the drafting problems with the statute itself and the probable unconstitutionality of one of its provisions.

Tyler v. Hennepin County: Invoking the Magna Carta to Combat “Home Equity Theft”
The Supreme Court recently ruled on a case out of Hennepin County involving the seizure and subsequent sale of real property for unpaid property taxes. The County sold Geraldine Tyler’s home for $40k to satisfy a $15k bill. Instead of returning the remaining $25k, the County kept it. The question the Court addressed was whether this act constituted a taking of property without just compensation, in violation of the Fifth Amendment.
