Minnesota’s nearly complete ban of non-compete agreements took effect on July 1. New non-competes are out, but employers are still able to utilize nondisclosure agreements to protect their trade secrets or other confidential information, and non-solicitation agreements are available to prevent workers from soliciting clients if they move to another job. However, some folks are of the opinion that the Legislature went too far with this legislation, and the alternative routes to protecting valuable company secrets and assets are not sufficient enough to be effective. William Pentelovitch joins us to outline the reasons why he believes that this new statutory framework creates a dangerous environment for innovation in Minnesota, as well as clues us in on the drafting problems with the statute itself and the probable unconstitutionality of one of its provisions.
