Advanced Negotiation Training

Mastering Difficult Conversations and Intractable Negotiations

Originally presented:  September 17, 2020     |     Course length:  6.0 hours

Take Your Negotiation Skills to the Next Level!

Skilled negotiators know that negotiation is about more than understanding the conflict, the applicable law and the other side’s position. It’s also about understanding the process itself and the many moving parts within it. In this seminar, negotiation expert Nina Meierding delves into the process and the minds of negotiators to provide attendees with a deeper understanding of the strategic and psychological dynamics of negotiation.

Nina Meierding is one of the most highly-rated speakers to have taught at Minnesota CLE seminars and has taught thousands of lawyers worldwide how to be better negotiators. In this advanced skills training she focuses on four key areas that many lawyers struggle with:

  • How to Negotiate with Highly Competitive People
  • Dealing with Volatility and High Emotion
  • The 7 Psychological Biases That Can Torpedo a Deal
  • Lying: Who Does It, When and Why

How to Negotiate with Highly Competitive People  (90 MINUTES)
Some negotiators act competitively even when it is in their best interest to be cooperative. This session will focus on how to work with people who are intentionally trying to distract you from your negotiating goals through the use of tactics. You will learn:

  • How to recognize and identify specific tactics
  • How different tactics are used at different times of the negotiation
  • How to pre-empt the use of tactics with proactive techniques
  • How to strategically – not emotionally – respond to tactics

Dealing with Volatility and High Emotion  (90 MINUTES)
Highly charged emotions – specifically frustration, anger and fear – can create havoc in a negotiation. We will examine a four-step process in which we:

  • Consider our own biases about emotion
  • Assess the timing of negotiation when high emotion is present
  • Learn how to create a supportive environment
  • Employ practical techniques for working with frustration, anger and fear

The 7 Psychological Biases That Can Torpedo a Deal  (90 MINUTES)
People, often unconsciously, can create their own obstacles to effective decision-making through status quo bias, confirmation bias, cognitive dissonance, reactive devaluation, sunk cost mentality, the endowment effect and optimistic overconfidence. Learn how to:

  • Recognize these obstacles in others
  • Recognize these obstacles in yourself
  • Explore customized strategies to work through them

Lying: Who Does It, When and Why  (90 MINUTES)
Whether to protect ourselves or others, whether to enhance our own self esteem or gain power, whether to keep a secret or take advantage of others, the average person tells some form of a lie multiple times per day. Understanding these multiple motivations will help us know how to respond in an effective way. We will learn how to:

  • Create environments where lying is less likely to occur
  • Detect when people may be lying
  • Develop customized strategies to deal with people who are lying
