Supreme Court Update: Permitting Requirements and Conditions after Sheetz v. County of El Dorado

In the case of Sheetz v. El Dorado County, the U.S. Supreme Court held that the Takings Clause of the Fifth Amendment applies to both legislative and administrative land-use permit conditions. The Court maintains that when the government imposes conditions on obtaining a building permit, those conditions must have an "essential nexus” to the government's land-use interests, and they must have a “rough proportionality” to the development’s impact on the land-use interest. The Court rejects the notion that legislative bodies are exempt from these criteria when imposing permit conditions.
