Constitutional Law: Social Media and the First Amendment – Lessons from TikTok v. Garland

The recent Supreme Court decision in TikTok v. Garland outlines the application of First Amendment scrutiny analysis to the Protecting Americans from Foreign Adversary Controlled Applications Act as applied to TikTok. However, the holding is narrowly focused, and the First Amendment analysis is incomplete in that the Court assumed without deciding the preliminary issue of whether the contested provisions are subject to First Amendment scrutiny. Despite these limitations, the opinion is an important look into how the Court views issues of national security, freedom of expression, data collection and privacy, and government regulation of social media and other platforms.
