There are certain title-related issues that may not be self-evident in the public records or in the chain of title. The title examiner, if only focusing on the documents filed at the county, is likely to miss serious title defects that impair property use and utility and potentially open themselves up to significant malpractice or title claims. This presentation will outline real-world examples of off-record title issues and provide guidance on how to discover them, what to be aware of, and help attendees learn how to avoid issuing title opinions or title commitments that inadvertently overlook title defects.
