Prepare, Prepare, Prepare – An Attorney’s Guide to a More Productive Mediation

In this presentation, two experienced mediators will discuss how attorneys can better prepare themselves and their clients before the mediation begins, and how they can work more effectively with mediators before and during the mediation to have a more productive session. Topics will include: 

• Working toward a “mediation mindset”
• Preparing for process decisions (client’s role, joint/separate sessions, opening remarks)
• Uncovering client’s interests
• Role of emotions
• Preparing for the “distributive dance” of negotiation
• Best practices for virtual mediations
