Minnesota’s privilege statute is intended to protect special relationships that are based upon confidentiality, free communication, and trust; however, this protection is not unbridled. The courts will and do control the applicability of privileges. This presentation addresses Minnesota’s privilege statute, the Minnesota courts’ interpretation of it, and federal treatment of the various privileges.
