As the Internet-of-Things leads to more connected devices, more and more industries and product categories will contend with standard essential patents (“SEPs”) and the licensing obligations relating to them. This seminar will look at the latest developments relating to both asserting and defending against SEPs, as well as how different courts view the FRAND licensing commitment (i.e., the obligation of SEP holders to license their patents on fair, reasonable, and non-discriminatory terms) and how courts internationally have addressed the conflicts that can ensue when SEP litigation is pursued in multiple jurisdictions at the same time. Finally, we will explore the recent trends in the US relating to damages and injunctions involving SEPs, as well as initial indications about how the Biden administration is approaching open questions involving SEPs.
