The power of generative AI to create a sophisticated digital likeness of an individual for unauthorized commercial purposes is cause for concern. Given the anticipated economic impact of AI, brand owners need to strategically implement forward-looking legal solutions to establish, protect, and monetize commercial rights in identity. In this presentation, Jake Abdo and Draeke Weseman will discuss securing personal brand rights in the age of AI by leveraging the Lanham Act’s protection against false endorsement together with state right of publicity laws to develop durable rights in identity.
