This session will focus on the current state of damages law and developments. The Fed Cir decision in MLC v Micron may affect damages disclosure requirements during discovery, Daubert, and when a district court can basically strike a plaintiff’s damages case. But even with some tightening in certain damages areas, we’re seeing very large damages verdicts in other cases – $1.9B in Centripetal v Cisco, $506M in Optis v Apple, and the VirnetX cases. This session will summarize these trends in damages law.
