Departing a law firm is fraught with ethical pitfalls and dilemmas – both for the departing attorneys and their old firm. The issues have resulted in ABA and state ethics opinions. Eric Cooperstein and Paul Floyd will explore the issues and practical ways to ethically and responsibly manage the departure of attorneys from a firm including duties to clients, who “owns” client files, fiduciary duties to former partners/employers, timing and content of notice of departure, and other issues that arise when attorneys depart from a law firm.
