Despite strong legislative proscriptions against the restraint of trade, the judiciary has created common law exceptions to the ethic that favors open competition. These exceptions often vary depending on the jurisdiction. In this presentation, Bill, Sarah, and Melissa provide an overview of the factors that Minnesota courts look at when determining the validity and enforceability of restrictive covenants.
