This presentation is a replay of a webcast originally presented June 27, 2023.
This course will address the importance of thinking about and recognizing potential appeal issues before, during and immediately after trial. You will learn the differences between the "trial brain" and the "appellate brain" and how those differences can lead to in-the-moment trial decisions that leave key issues either unreviewable or well-positioned for appeal. Presenters will identify appellate issues that trial litigators should consider at every stage of litigation before trial, from the preparation and filing of the complaint and discovery; to identifying issues for interlocutory appeal; to motions in limine. They will also discuss issue preservation at various stages of the trial and the importance of post-trial motions.
