2024 Legislative and Case Law Update
Join Suzanne Scheller, Chair of the Legislative Committee for the Elder Law Section, for the annual legislative and case law update. The 2024 Minnesota Legislative Session was the second year of a biennium with a historic number of bills. Learn about what legislation passed in 2024 and cases or other items of note that may impact our practice and our clients, including topics related to medical assistance, license requirements for providers, guardianships, housing, and other areas.

Medicaid Policy 2024: Upcoming Changes and Potential Opportunities
Medicaid estate recovery historically has imposed particularly harsh consequences on BIPOC families. Pending federal legislation would eliminate estate recovery, while the federal MACPAC Commission has recommended several consequential reforms. This session will discuss estate recovery’s negative impact on Minnesota communities along with possibilities for reform. The session also will cover the implementation process for several recent federal Medicaid LTSS regulatory changes, including the adoption of minimum nursing facility staffing levels and the many HCBS changes required by the Medicaid Access Rule. Attorneys and other advocates will want to engage with Minnesota Medicaid on these issues as soon as possible, as the implementation process will be critical if changes actually are to benefit beneficiaries in a real way.

National Guardianship Association Perspective on Guardianship Status and Trends
Guardianship across the country varies greatly in oversight, implementation, funding, legislation, who is able to serve as a guardian and requirements to serve as a guardian. This presentation will provide an overview of the current status and efforts to move guardianship towards a more uniform practice. We will discuss the strengths and weaknesses of Minnesota’s current system, requirements and suggestions on how to improve upon our current system.
