Trust and estate disputes can present a myriad of issues, including fiduciary problems, family dynamics, creditor issues and unclear estate plans just to name a few. Because these cases present unique concerns and issues, attorneys need to know how to effectively prevent fights, settle them efficiently or move a case through court when litigation is unavoidable. Also, estate and trust litigation frequently intersects with other practice areas. Therefore, to provide effective representation, estate and trust litigators must have a basic knowledge of other practice areas and a willingness to collaborate with other attorneys as needed.

This panel discussion will explore options for dealing with competing interests when the largest asset is the family farm. Learn strategies for balancing the interests of the farming heir and the non-farming heir and how to resolve tricky issues that may arise in this context.

Real Estate: The Other Kind of Dirt Law – Exploring the World of TODDs and Partition Actions
Transfer on death deeds (TODDs) can be a useful tool for estate planning attorneys, but TODDs are not a “one size fits all” solution. This session will give you tips on talking to clients about when a TODD is appropriate. The presenters will also discuss what happens when a TODD goes awry and winds up in court via a partition action.

Knives Out: Crimes Against the Elderly – What to Look For and How to Take Action
Unfortunately, elder adults can be especially at risk of being a victim of abuse, neglect and financial crimes. Knowing basic definitions and dynamics is the starting point for understanding options and taking action. In this session, you will learn what to look for and steps you can take when you suspect a client may be the victim of abuse.

Judgments and Collections 101 – The Trust and Estate Litigator’s Toolbox
In this presentation, an experienced collection counsel will provide a general overview of the collection process and will examine some of the most commonly employed collection techniques used on a day-to-day basis. This presentation will provide a great introduction to judgments and collection law or a refresher for those that don’t do a great deal of this work in their practice.
