Under current trust law, there are a number of different ways to modify an irrevocable trust, such as judicial modification, non-judicial modification, settlement agreement, and decanting. With the ability to modify irrevocable trusts, estate planners can now reform and update trusts to take advantage of changes in the law or to better suit a family’s needs and circumstances. But what is the best approach to use to modify a trust? This session will examine the various approaches to trust modification and the advantages and disadvantages of each approach.
