As the cultivation, distribution, sale, and possession of cannabis and THC products transitions from criminal prohibition to a civil regulatory structure, many rules, processes, and guidelines of the criminal probation era remain. These "temporary" problems should be resolved over time as legalization develops, but they present unique issues and challenges at this stage. This presentation focuses on the current state of the criminal law considerations and does not delve into the civil regulatory structure.
