With the legalization of recreational marijuana in Minnesota, the conversation surrounding the intersection of family law and cannabis has become more complex. No longer can the legality of use dictate the outcome of the analysis. Attorneys and courts must look deeper into issues of how to properly apply and weigh marijuana use to the best interest factors framework. In addition to considering how legalization should affect new family law cases, it is important to weigh how existing provisions in family law orders are affected.
