Special needs trusts can be powerful planning tools, but they also raise a host of practical and legal questions for attorneys who do not work with them regularly. This session answers the questions practitioners hear most often, including when a special needs trust is appropriate, the differences between first-party and third-party trusts, funding considerations, trustee responsibilities, and how these trusts interact with public benefits programs such as Medicaid and Supplemental Security Income (SSI).
