In 2020, nearly half of IPR petitions were denied institution and of those about 40% were denied institution for discretionary reasons. With Fintiv/NHK Springs, General Plastics, and the various PTAB rule changes under former PTO Director Iancu making IPR institution increasingly challenging, it is more important than ever to have a well-planned IPR strategy. In this seminar, we will explore insider tips and strategies for getting your IPR instituted and for surviving IPR as a patent owner. We will also discuss the forthcoming Supreme Court decision in Arthrex, other constitutional challenges to the IPR regimes on the horizon, recent developments and trends involving IPRs at the Federal Circuit, and what to expect under the Biden administration for IPR reform and rule changes.
