Closely Watched Cases This Term – Discrimination, Immigration and Religion
Our panel of experts discuss decisions in three key areas:
1) The Court’s landmark ruling that TitleVII’s prohibition of discrimination because of sex includes sexual orientation and gender identity;
2) The 5-4 decision invalidating President Trump’s reversal of former President Obama’s Deferred Action for Childhood Arrivals (DACA) Executive Order; and
3) Religion cases, including Espinoza v. Montana addressing school vouchers, Little Sisters of the Poor addressing exemptions from providing contraception under health plans, Trump v. Pennsylvania addressing related issues, and St. James School and Our Lady of Guadalupe School regarding the application of discrimination laws to employees with religious roles in religious institutions.

This session addresses several high-profile cases, including:
1) Trump cases addressing the House of Rep’s authority to subpoena creditors and businesses of the President;
2) Presidential-elector cases out of Washington State addressing whether a state can force electors to vote consistently with the state’s popular vote;
3) The decision in Seila Law addressing whether the Consumer Financial Protection Bureau is unconstitutional; and
4) The decisions in June Medical Services addressing Louisiana’s restrictions on abortion.
Plus a quick, high-level look at the Court’s decision not to grant review of qualified immunity cases this term.
