This presentation will be a survey of those gray areas where employment lawyers meet benefits lawyers. From the perspective of an outside employment lawyer and an inside benefits lawyer, we will work through a number of gray-zone issues in the following common topic areas:

  • How leaves and benefits work together – what’s required by law, what’s typical practice;
  • Disability and termination of employment – what discharge does to an employee’s health coverage, retirement benefits, disability benefits and accrued vacation;
  • Severance agreements for departing employees and employment agreements for new hires – avoiding 409A pitfalls; and 
  • ERISA-mandated employee communications
