It is well known that the work product doctrine shields materials prepared in anticipation of litigation. However, what actually qualifies for protection is much easier to define in theory than in practice. In this presentation, our esteemed presenters will lay out the definition and elements, then walk through the application of work product principles, expert work product, and compelled disclosure of work product to exemplify the proper application of the doctrine.
