Mistakes happen. If addressed early enough, most mistakes can be fixed. The presentation will focus on helping lawyers determine ethically what to do when a mistake happens. In particular, this presentation will focus on the obligations owed to a client under Rules 1.4 (communication) and 1.7 (conflicts) of the Minnesota Rules of Professional Conduct, as well as additional considerations for best business practices. This presentation will include a discussion of ABA Formal Opinion 481 “A lawyer’s duty to inform a current or former client of the lawyer’s material error.” As well as the proposed amendment to current Lawyers Board Opinion 21 on this same topic.
