Business Litigation: Top Tips for Drafting Pleadings and Presenting Motions

Business litigators Steve Kerbaugh and Dan Hall will discuss best practices for commercial litigation pleadings in Minnesota federal and state courts. Topics include: 

  • working with corporations to understand objectives and design appropriate litigation strategies; 
  • drafting complaints with sufficient detail to survive Rule 12 motions; 
  • drafting effective and comprehensive responsive pleadings, including answers, counterclaims and third-party claims; 
  • appropriately framing non-dispositive motions, including motions to amend and discovery motions; 
  • effectively presenting dispositive motions, including motions for injunctive relief, summary judgment and Daubert exclusion; and
  • adhering to best practices to ensure that clients’ interests are effectively presented in written submissions to the courts.
