9:20 – 10:05 a.m.
A New Relationship with the United States – Risk, Opportunity, and Interacting with the Second Trump Administration
One of the worst days in-house can involve the United States – a government subpoena, termination notice, or burdensome regulatory requirement. From DEI changes to investigations to terminated grants: lawyers will be vital partners to organizations and institutions navigating the Trump Administration’s significant changes to settled expectations. Federal contractors and grantees, in particular, should identify and mitigate risks, develop new compliance programs and procedures, and understand available remedies for disputes under existing funding instruments with the United States. Planning now about key risk areas will enable your organization to respond calmly and coolly if, and when, government scrutiny or change comes – it will also help de-risk the future.
– Alexander P. Hontos & Nicole Engisch

What To Do When Your Client’s “Return to Work” Dream Becomes a Nightmare – Including for the Legal Department
What happens when an operational need or desire for new or increased in-person work meets the reality that return-to-work mandates can cause low worker morale, negatively impact recruitment and retention, and not yield the desired outcomes from more in-person interactions – including for the legal department? What are the best practices for avoiding bad outcomes and successfully bringing employees back to the workplace?
– Daniel G. Prokott

1:30 – 2:15 p.m.

Restrictive Covenants – What’s Banned and What’s Not
For many years businesses could protect their confidential information and employee and customer relationships with restrictive covenants such as non-solicitation and non-competition agreements. Now courts are reviewing them with increased skepticism. Learn what’s banned and what’s not, and how to successfully navigate in this new era.
– Randall Kahnke & Lauren W. Linderman

Ethical Quicksand: In-House Counsel’s Playbook for Meeting Ethics Duties During Their Client’s Worst-Case Scenarios
1.0 ethics credit applied for
From headline-making data breaches to high-stakes regulatory investigations to significant employee losses due to work policies and more, in-house counsel are often on the front lines of “worst-case scenarios.” This session offers practical, actionable insights on an attorney’s professional responsibilities when navigating these emergencies including:(1) the crucial question of “who is the client?” – exploring how counsel can avoid inadvertently tailoring advice for individual employees rather than the organization itself; (2) the duty to keep the organization informed and “report up” when necessary; and (3) the duty of confidentiality and preventing and handling breaches of attorney-client privilege – whether inadvertent or malicious.
– Jennifer R. Coates & Roxanna Gonzalez
