Post-Chevron Deference Guidance and the Implications for Federal and State Banking Regulation
In Loper Bright Enterprises, the Supreme Court overturned the longstanding Chevron doctrine, which directed courts to defer to an agency’s reasonable interpretation of ambiguous statutes that it administers. The Court held that the Administrative Procedure Act requires courts to exercise “independent judgment” in determining whether an agency’s actions align with its statutory authority. Hear what all of this means for the world of banking regulation going forward and receive guidance for banking law practice in the post-Chevron era.
