This session will discuss how law enforcement conducts investigations for cannabis impairment with special emphasis on Minnesota’s New Oral Fluid Roadside Testing Project. The session will cover common legal issues in cannabis-impaired cases, how to present and analyze evidence in these cases from the perspective of the prosecution, and current case law.

It will also explore the specific laws and sentencing enhancements applicable to repeat offenders; the admissibility and use of prior DWI convictions in court, including potential challenges and counterarguments; and mitigation strategies you may use for cases involving serious injury, death and repeat offenders.
