The Fifteenth Amendment prohibits state actors from denying or abridging a citizen the right to vote based on that citizen's “race, color, or previous condition of servitude," and the Voting Rights Act provides additional protections against racial discrimination in voting. However, after a record 2020 election turnout, several states have sought to restrict access to the vote by enacting new laws. In fact, legislation that aims to limit who can vote, where, when and how has reached levels this year not seen for decades. This presentation will provide a survey of the trends in voting legislation as well as recent caselaw interpreting and enforcing America’s right to vote. Learn from a voting and election law expert what he believes is the aftermath of the 2020 election and what lies ahead for future elections.
