Arbitration clauses have received a great deal of attention in recent years. As the use of mandatory arbitration clauses increases, a growing number of employees and consumers learn they must subject their disputes to arbitration. Even outside this context, parties often include arbitration clauses in their agreements, believing arbitration will be a more efficient way to resolve disputes.
Parties often think of arbitration in terms of who will decide their case. But have parties thought about what arbitration means for discovery? What limitations or dangers could dramatically affect their case? Presenters will address some of the limits, challenges, and unforeseen risks in arbitration discovery so you can draft better arbitration clauses and better prepare your case for a final hearing.
