Association health plans allow small employers to join together to form a bigger group, which allows them to participate in the large group market and more. However, when multiple employers join together to provide health coverage, the employers create a multiple employer welfare arrangement (or a "MEWA"), which is subject additional federal and state regulation. Recent Department of Labor regulations amend the definition of employer to make it easier for employers to form groups, but they do not address the regulation of MEWAs. This presentation will review the new regulations and look at the regulatory obstacles that face association health plans – from federal and state regulation to working with insurers and third-party administrators ("TPAs") to offer such plans.
