How to Litigate the Mild Traumatic Brain Injury Case: Diagnosis, Damages and Proof Requirements

Originally presented:  April 9, 2018     |     Course length:  1.0 hour

New diagnostic methods able to confirm concussion and mild traumatic brain injury (mTBI) appear daily, including the recent FDA-approved blood test that detects injury-related proteins in the bloodstream immediately following head trauma. During the session you will review common diagnostic methods including clinical assessment, CT Scan, MRI, and neuropsychological evaluation and also review a variety of damage claims associated with mTBI including claims for tinnitus, balance disorder, visual compromise, and cognitive deficit.

The talk will also address evidentiary burdens, proofs and common defenses. Join this informative review of mTBI-related issues and learn practice pointer take-aways that will help your clients obtain the best representation possible in matters that can at times be confusing and that often result in disputes about causation and the reasonableness and necessity of care, as well as the damages associated with it.
