From the Director’s Office: Retainer Agreements, Fees and Termination of Representation

Kevin Slator and Amy Mahowald from the Minnesota Office of Lawyers Professional Responsibility will discuss how lawyers can ethically get into and out of lawyer client relationships. Retainer agreements present particular challenges for attorneys. For example:

  • When can advance fees go into an operating account?
  • How can a lawyer structure a flat fee?
  • How and when can a lawyer withdraw when fees are not paid?
  • What is a lawyer’s duty to refund advance fees?
  • What is an unreasonable fee?

These are just a few issues that can arise. Join us for this session which will cover proper retainer agreements, advise on how to approach termination and issues around fees that run afoul of the ethics rules.
