Transfer on Death Deeds
TODDs are a valuable probate-avoidance planning tool, and have practical applications in both estate, tax, and MA planning, but TODDs are not a onesize- fits-all solution for clients with real estate. This session will demystify Transfer on Death Deeds (or TODDs) and go through the requirements for effective TODDs, forms for practitioners to use, important discussion topics when advising Grantor Owners about TODDs, implications of multiple Grantee Beneficiaries, and common issues surrounding TODDs.

There are several reasons to use a TODD, especially to avoid probate proceedings. However, disadvantages, such as a public record upon recording and lack of beneficial tax consequences, do exist. Join us for a thorough discussion on the pros and cons of this popular tool.
