Trademarks are one of the most important assets a company owns, and unlike other forms of intellectual property, trademarks and service marks can last forever. This course is designed to explore the basics of federal and state trademark law, and will provide a roadmap through the process of advising clients on choosing a trademark, properly identifying the type of protection available, preparing and filing the trademark application, if appropriate, and completing the registration. In addition, this course will explore how to enforce, transfer and assigned trademark rights.

Trademark Law 101
Trademark rights can be confusing to the new and inexperienced, and sometimes even experienced counsel could do a better job of communicating the fundamentals to business leaders or non-IP counsel. The goal for this session is to provide you with tools to better understand and communicate the basics of trademark rights. As a foundation for later sessions in the day, we’ll explore how trademark rights arise, trademark ownership and transfer, differences between U.S. and foreign/international rights, and best practices for building and maintaining a trademark portfolio.

How to Clear and Register Trademarks
Learn the importance of searching and clearing trademarks so that you select a mark that does not infringe on another’s trademark rights. Understand how to federally register trademarks and why it is important to do so. A sample trademark clearance opinion, a real trademark office action refusal and a successful response, along with a checklist for preparing a trademark application will be provided.

How to Creatively Enforce Trademark Rights
Now that you know how to create trademark rights and register them, what’s next? Enforcement! Learn how to enforce your trademark rights in a variety of ways (from online takedowns to district court litigation), and why enforcement is so important. Bring your questions and war stories for this interactive discussion! A sample demand letter, Notice of Opposition, and Federal District Court Complaint will be provided.
