Antenuptial (or premarital) agreements play an important part in family law cases (i.e., dissolution proceedings) and estate planning. These agreements allow individuals to control the disposition of their financial assets, their estate’s financial commitments, and define the legal process upon divorce or death. Antenuptial agreements allow for the parties to reach agreements that are outside of or do not conform to the state statutory system and, presumably, the courts. Instead, the parties are able to create their own governing process to dictate what occurs upon divorce or death.
