Hot Topics in Attorney-Client Privilege for In-House Counsel

In today’s businesses, corporate counsel play a variety of business and legal roles: corporate attorney, business advisor, corporate officer, contract negotiator, personnel director and personal adviser to executives and employees. But the attorney-client privilege applies only when corporate counsel’s communications provide legal advice. In this presentation, presenters will provide insight on how to recognize corporate counsel’s role at any given time and practical guidance on how to distinguish discoverable business communications from privileged legal communications. Presenters will also address exceptions that may make otherwise privileged communications discoverable or admissible in litigation, with particular emphasis on the crime-fraud exception.
