E-Discovery Ethics
- Zealous Representation and Proper
Tactics
How do you strike the right balance to fulfill your duty to be
zealous in discovery without crossing the line into pursuing costly
e-discovery battles for tactical advantage? What does it take to
competently and diligently represent your client when conducting or
responding to e-discovery?
- Document Preservation
What are the ethical duties associated with maintaining and
preserving documents in their electronic (versus paper) form? How are
these issues arising in real-world litigation scenarios?
– Donald H. Nichols & George J. Socha
11:00 – 11:15 a.m.
BREAK
11:15 – 12:15 p.m.
Client Confidences and Electronic Data
The confidences and secrets which we are ethically obligated to
protect for our clients are, more and more, stored electronically. This
raises a host of ethical and practical questions. This session will
provide an overview of some of the more prevalent and upcoming issues
surrounding email, wireless networks, wireless communication, data
security, metadata, Trojans and viruses.
– Peter H. Berge
