There are many effective styles of legal interviewing and counseling and there is no set pattern of problems presented to attorneys by their clients. This course provides participants with the opportunity to work with individual clients and simulated corporate clients and will discuss firm policies, fee agreements, and the ability of the firm to respond to a variety of legal matters. Presentations will be videotaped and critiqued by faculty serving as potential clients.

How to Conduct an Effective Jury Trial (5 days)
Learn to develop the skills and insights that will enable you to try your next jury trial confidently and purposefully.
You’ll spend your time completely immersed in the task of honing your skills. You’ll cover trial notebooks, direct and cross exam, impeachment, rehabilitation, direct and cross of expert witnesses, opening statements and summations. You and your fellow registrants will then practice your skills by litigating a jury trial.
You’ll learn:
How to develop a theory of the case and how to organize and present the evidence necessary to gain acceptance of that theory
How to organize and create a trial notebook that will enable you to maintain control from voir dire to verdict
How to deliver an opening statement that sets the stage
How to organize direct and cross exams that keep a judge and jury awake and intrigued
How to phrase questions to maximize testimonial impact and maintain control of the witness
How to present real and demonstrative evidence that jurors will understand and remember

How to Conduct an Effective Voir Dire (1 day)
Practical skills you can use in your next trial.
Participants will have the opportunity to act as both jurors and attorneys and to experiment with the appropriate art of jury selection.
You’ll learn:
Theories of jury selection
Jury research and voir dire
Relationship of voir dire to the theory of the case
Challenges for cause
Peremptory challenges
How to phrase questions that give information and those that get information
How to deal with strengths and weaknesses of the case, client and witnesses
Providing information about the facts, law and people involved
How to Examine Accountants and Appraisers Effectively (1 or 2 days)
This course allows you to focus on the examination of accounting and appraisal experts so that the judge and jury understand and are persuaded. The course materials consist of two separate condensed fact situations, and each participant will have the opportunity to prepare and conduct both a direct and cross examination.
How to Examine Medical Experts Skillfully (1 or 2 days)
Learn how to work confidently and effectively with medical testimony, evidence and exhibits.
Few direct or cross examinations are as difficult for attorneys, or as inscrutable to a jury, as the examination of a medical expert. This course is devoted exclusively to the direct and cross examination of medical experts and the use of real and demonstrative medical evidence.

How to lay a rock-solid foundation for your medical expert’s testimony
How to organize the direct exam for maximum testimonial impact
How to explain complex medical concepts to a jury
Common weaknesses in evidentiary foundations and how to exploit them
How to impeach the testimony of opposing experts

How to Examine Witnesses Effectively (2 days)
Identify and develop the crucial skills necessary to conduct direct and cross exams and to introduce exhibits.
There is no element of effective advocacy more important than preparation and there is no one quite so embarrassed as the advocate who is unprepared. On the other hand, effective preparation makes you a more confident, more comfortable, more credible litigator. It is important to know your client and know the facts, but it is just as important to know what to expect.

How to organize direct and cross-exams that keep a judge and jury awake and intrigued
How to phrase questions to maximize testimonial impact and maintain witness control
How to present documentary evidence to teach the jurors what the documents say
How to create and present visual aids that jurors will understand and remember
How to prevent your expert’s testimony from being nullified by an opposing expert

How to project a confident, persuasive persona through voice control, eye contact, presentation tone and physical presence
How to Give Forceful Presentations That Persuade (1 day)
This unique course is designed for litigators and non-litigators alike. Participants will make two presentations – one to a school board and one to a county board. Participants must persuade the school board to adopt a position for funding either sports or fine arts in the first exercise and persuade the county board to fund parks or development in the second exercise. Presentations will be videotaped and critiqued by faculty serving as board members. Specific skills and strategies will be taught and developed in student participants.

Learning to work with exhibits confidently and to use them for powerful effect with the judge or jury.

Understanding the negotiating process and techniques, and developing a negotiation plan can only enhance your chances for a successful negotiation result. You will learn how to begin your negotiations, how to conduct your negotiations and how to deal with the negotiating techniques of your adversary. You will experiment with different styles of negotiation and assess their effect on you and your opponent. You will practice techniques appropriate to the different stages of a negotiation, practice preparation with a colleague, and give and receive feedback on your performance. You will begin to develop a greater confidence in your ability to negotiate with the best.
